Sample Rental Agreement

The following "Rental Agreement" is provided for illustration purposes only. The agreement our guests receive vary in accordance to the particulars of the rentals. The following sample does not imply an offer to rent.

Rental Agreement

This "Rental Agreement", between John Doe ("Client") and Truffaut Property Management, LLC ("Owner"), concerns rental of the apartment located at XX, 75017 Paris, France.

Definitions
The parties agree to the following definitions and terms:
  • All times presented in this "Rental Agreement" are in Paris local time (Greenwich Mean Time plus one hour).
  • All currency amounts in this "Rental Agreement" are in U.S. dollars.
  • All payments may be paid by VISA or MasterCard, wire transfer, direct deposit, electronic funds transfer, money order, or personal or bank check drawn on a U.S. bank.
  • The term "guests" refers to the persons listed immediately below, as well as any other individuals the Client or the Client's guest(s) may invite into the building.
Rental Term
  • The rental period shall begin at 2:00 p.m. on Sunday, April 11, 2004 and shall conclude at 10:00 a.m. on Sunday, April 18, 2004.
  • The apartment shall be occupied by the following persons only:

  • The Client shall have sole authority to enter into this "Rental Agreement" and to act on behalf of the persons listed above. The Client shall be the primary point of contact with the Owner and may be reached at:

Rental Fee

  • The rental fee for this period shall be $980.00. This fee shall include linens, cleaning before and after the rental period, and all utilities, except telephone usage.
  • The cleaning fee for this period shall be $40.00. This fee shall include up to two hours of cleaning and laundry following check-out.
  • The Client shall pay a deposit of $510.00 at the time of the reservation. The apartment shall not be considered by either party to be reserved until the Owner has received the reservation deposit and this signed "Rental Agreement."
  • The balance of $510.00 plus a security/telephone/key ("STK")deposit of $400.00 shall be due no later than forty-five (45) days prior to the reserved arrival date.
  • If this "Rental Agreement" is executed less than forty-five (45) days prior to the reserved arrival date, the entire rental fee of $980.00, the cleaning fee of $40.00 and STK deposit of $400.00 shall be due immediately.
  • Failure to vacate the apartment at the conclusion of the rental period shall result in an assessment of pro-rated rent plus a surcharge of $150 for each additional day, or portion thereof, beyond the conclusion of the rental period. Should the Client like to remain in the apartment for a longer period than originally reserved, he/she shall assume the responsibility of contacting the Owner to make arrangements. The additional rental fee for the extension period shall be paid in full before the beginning of the extension period. Extension of the rental period shall be solely at the Owner's discretion.

Cancellation

  • The Client shall notify the Owner of his/her intention to cancel a reservation by fax, email or mail. The Client shall not consider a reservation cancelled until the Owner has acknowledged receipt of the cancellation notice.
  • If the Client cancels a reservation, the fees are refundable as follows:
    • More than forty-five (45) days before the reserved arrival date: 100% of the reservation deposit, less a $100.00 administrative fee.
    • Between forty-five (45) and thirty (30) days before the reserved arrival date: 50% of the rental fee, less a $100.00 administrative fee.
    • Less than thirty (30) days before the reserved arrival date: 0%.
  • If the Client cancels a reservation, the Owner shall make the apartment available for rent to other clients. If the apartment is rented to another client for the entire rental period, the Owner shall refund 100% of the paid rental fee, less a $100.00 administrative fee, regardless of the cancellation date. If the apartment is rented to another client for a portion of the rental period, the refund shall be prorated accordingly, less a $100.00 administrative fee.
  • If the Client vacates the apartment before the reserved departure date, no refund of the rental fee shall be due to the Client unless the Owner rents the apartment to another client for the remainder of the rental period. If the apartment is rented to another client for the entire remainder of the rental period, the Owner shall refund the daily rate for the number of days subsequently rented, less a $100.00 administrative fee.
  • The Owner reserves the right to cancel any reservation at any date for any cause. If a reservation must be canceled by the Owner for any reason other than the Client's failure to abide by the terms of this "Rental Agreement", the Owner shall refund 100% of all paid fees and shall provide the Client with a non-transferable certificate valid for a 10% discount on a future rental. Additionly, the Owner shall make reasonable efforts to assist the Client in locating other suitable accommodations for the rental period.

Security/Telephone/Key ("STK") Deposit

  • Cancellation shall not affect the return of the STK deposit.
  • The STK deposit shall be held by the Owner against damage, excluding normal wear, to the building (interior and exterior), and the apartment and its contents; missing contents; and telephone usage. The STK deposit shall be used only to offset damage, loss or telephone usage caused by the Client and/or guests. The STK deposit shall extend to damage, loss or telephone usage caused by a third party and aided by the negligence of the Client and/or guests.
  • The Client shall exercise reasonable diligence in preventing damage or other loss, including without limitation, locking doors and windows when absent from the apartment, maintaining the secrecy of the electronic alpha-numeric entry codes, unplugging electrical appliances when not in use, and ensuring that water faucets are securely turned off.
  • The Owner shall maintain a detailed "Inventory & Condition Report" for the apartment and its contents for use in determining the nature and extent of damage or loss that has occurred. The Client shall have opportunity to review and annotate the "Inventory & Condition Report" at the beginning and end of the rental period. The Owner and/or its representatives shall have sole authority to determine the condition of the building, and the apartment and its contents; and to assign responsibility for damage, loss or telephone usage to the Client.
  • The Client shall be responsible for the full cost of repairs to the building and the apartment; repair and/or replacement of damaged contents; replacement of missing contents; and telephone usage. The extent of the Client's financial liability shall not be limited to the amount of the STK deposit, and the Client agrees to pay all repair and/or replacement costs in full within fourteen (14) days of receipt of a detailed invoice. In addition to paying the STK deposit at the time of the reservation deposit, the Client shall also provide a credit card authorization to charge excess costs to the account.
  • Smoking inside the apartment (including on the balcony or in the building's stair hall) is prohibited. Any evidence of smoking will result in forfeiture of the entire STK deposit plus any additional costs to have the apartment and its contents professionally cleaned to remove smoking odors.
  • The keeping of pets inside the apartment is prohibited. Any evidence of pets will result in forfeiture of the entire STK deposit plus any additional costs to have the apartment and its contents professionally cleaned to remove pet hairs, stains and odors.
  • The Owner shall refund any unused portion of the STK deposit no later than thirty (30) days after the departure date.

Utilities

  • The rental fee shall include water, sewer, electricity, gas, trash collection and ADSL internet access.
  • The rental fee shall not include telephone usage. The telephone is metered and local calls shall be billed at France Telecom rates against the STK deposit as described above. Long distance calling shall be available only with the use of the Client's personal calling card.

Additional Cleaning Services

  • The apartment shall be cleaned prior to the beginning of the rental period. The Client shall have use of a washing machine inside the apartment at no additional charge.
  • The Client shall leave the apartment in good condition at the conclusion of the rental period. The cost of additional cleaning services beyond the normal two-hour cleaning shall be deducted from the STK deposit as described above at a rate of $25 per hour.
  • The Client may arrange for additional cleaning services to occur during the rental period at a rate of $50.00 per two-hour cleaning service. The date(s) of additional services must be arranged no later than thirty (30) days prior to the reserved arrival date. The fees for additional service(s) must be paid along with the balance payment.

Personal Conduct

  • Inasmuch as the apartment is in a residential building located in a residential neighborhood, the Client shall ensure that his/her conduct and that of guests is not disruptive to other residents or to the the environment.
  • While on the premises, the Client and/or guests shall not knowingly violate the norms of civilized society or any local, national or international law.
  • The Owner shall apprise the Client of any building regulations that may reasonably affect the Client during the rental period and the Client shall abide by the regulations.
  • The Owner shall not be responsible for socially inappropriate, illegal and/or uncooperative behavior on the part of the Client and/or guests.
  • The Client may conduct legal business from the apartment, but may not conduct business activities that require regular customer traffic, that disturb other residents, or that are in conflict with the building's regulations.
  • Socially inappropriate, illegal and/or uncooperative behavior committed on the premises shall be cause for immediate termination of the rental agreement, for which there shall be no refund of any portion of the rental fee.

Limitations

  • The Owner shall not be liable for any death, injury, or property damage/loss that may occur during the rental period. The Client agrees to hold the Owner harmless in the event of any such occurrence.
  • The Owner shall not be liable for any financial or other loss resulting from cancellation or from eviction for cause. The Client agrees to hold the Owner harmless in the event of any such occurrence.

Travel Insurance

  • The Owner hereby advises the Client that French law requires that renters obtain travel insurance, including coverage for personal liability, to be in effect during the rental period.

Dispute Resolution

  • The Owner shall make all reasonable efforts to ensure the Client's satisfaction and to maintain a cordial relationship.
  • The Client agrees to make all reasonable efforts to resolve any disputes directly with the Owner before turning to other possible sources of resolution.
  • The information presented at www.RentalApartmentParis.com or in any other promotional venue has been reviewed as carefully as possible to represent the actual condition of the apartment and its contents, but the Client shall not interpret this information as a perfect representation.
  • The Client shall not hold the Owner liable for sudden and unpredictable disruptions to utility service or amenities; or to the habitability of the apartment during the rental period. In the event of any such occurrence, the Client shall immediately notify the Paris-based property manager for resolution.
  • If fees have been paid using a credit card, the Client agrees not to initiate a charge-back as a resolution to any dispute.
  • Disputes are ultimately subject to the laws of the Republic of France.
